These Peacock Gift Card Terms and Conditions (these “Gift Card Terms”) describe the terms and conditions that apply to Peacock gift cards (in digital or physical form) (“Gift Cards”), regardless of where or how purchased.

The purchase and use of Gift Cards are also subject to the Peacock Terms of Service and Privacy Policy, which contain, among other things, applicable legal provisions and definitions for some of the terms used in these Gift Card Terms. These Gift Card Terms constitute “Supplemental Terms” as described in Section 1.3 of the Peacock Terms of Service.

1. Acceptance of Terms and Issuer Responsibility.

1.1. Acceptance of Gift Card Terms. These Gift Card Terms constitute an agreement between you and Peacock Cards, Inc. (“Issuer”). By purchasing, accepting, or using your Gift Card, you agree to be bound by these Gift Card Terms. If you do not agree with these Gift Card Terms, do not purchase, accept, or use the Gift Card. Issuer reserves the right to change these Gift Card Terms from time to time in its sole discretion, which changes we may provide to you by any reasonable means, including by posting the revised version of these Gift Card Terms on Peacock’s website.

1.2. Issuer Is Solely Responsible. The Gift Cards are issued by Issuer, who is solely responsible for the operation and maintenance of the Gift Card program. Issuer is the sole legal obligor to you, provided that Issuer may assign its obligations with respect to the Gift Cards, at any time without notice, in which case the assignee will become the Issuer and sole legal obligor to you. Peacock TV LLC and its affiliates and related entities other than Issuer (collectively, the “Other Peacock Companies”) bear no responsibility or liability for any Gift Cards, and you hereby knowingly release the Other Peacock Companies from any and all liabilities or claims of any nature whatsoever arising in connection with the Gift Cards.

2. Purchase and Redemption of Gift Cards

2.1. Purchase. Gift Cards can be purchased online through the Peacock Service, and Issuer may also make Gift Cards available for purchase at authorized third-party retail outlets. Gift Cards may be offered in various denominations. Once a Gift Card is purchased, the value of the Gift Card cannot be increased.

2.2. Eligible Services. Gift Cards constitute pre-paid subscriptions to eligible Peacock Services (“Eligible Services”). Eligible Services may exclude certain Service Tiers and are subject to change in Peacock’s sole discretion. If you choose to subscribe to Peacock Services other than Eligible Services, a credit card or other payment method will be required.

2.3. Redemption. To redeem a Gift Card, you will first need to register for an account through Peacock’s online registration process if you do not already have one. After creating an account, you can redeem the Gift Card by inputting the code associated with it in the payment section of your Account. Gift Cards are redeemable up to their balance only and must be redeemed all at once to a single Peacock account. Once the Gift Card is redeemed to an account, the entire Gift Card balance will appear as a credit to the account until used. The remaining balance can be viewed at any time in the Account section of the Peacock Service. Your account will be debited the price of the Eligible Service (plus applicable taxes and fees) starting on the day the Gift Card is redeemed and each subscription period thereafter until the Gift Card account credit is fully used. An account balance that is insufficient to cover the cost of the next full billing period, will require an additional payment for the balance due. If no additional payment is provided, your entitlement to the Eligible Service will end and the remaining balance of the Gift Card will be stored to your account as a credit until either: (i) the balance is applied to a subscription that the balance is sufficient to pay for in its entirety, or (ii) an additional form of payment is added to your account, in which case, the credit will be applied first and the additional payment will be applied to cover the difference. If provided, your additional payment method will be charged the price of the Eligible Service (plus applicable taxes and fees) on a recurring basis for continued access to the Peacock Service as more fully described in Section 2 of Peacock’s Terms of Service.

2.4. Expiration and Forfeiture. Gift Cards do not expire. Maintenance, dormancy or service fees do not apply to balances on Gift Cards. Issuer reserves the right to refuse to honor any Gift Card in the event of a disputed credit card charge, bounced check or other payment problem.

2.5. Interruption of Service. In the event the Gift Card system becomes temporarily inoperative, you may be unable to (i) obtain information about the balance on your Gift Card or Gift Card transactions, or (ii) use your Gift Card to pay for purchases during that time. Please notify Peacock or Issuer if you experience any problems using your Gift Card. You agree that Issuer and its parent, affiliates or subsidiaries are not responsible for any interruption of service or the quality, safety, or any other aspect of any goods or services purchased by you with your Gift Card.

2.6. Restrictions. Gift Cards will not be redeemed if the card number is invalid or the card has not been activated. Gift Cards will not be redeemed for subscriptions to the Peacock Service through a third party. Peacock reserves the right to restrict the redemption of more than $1,000 in Gift Card balances by one person in any 30-day period. Peacock reserves the right to refuse to honor a Gift Card where Peacock suspects that the Gift Card was obtained fraudulently.

3. Delivery and Risk of Loss

3.1. Delivery. When you purchase physical Gift Cards through Peacock, you will pay any and all freight, shipping and any other affiliated charges or duties associated with delivery of the Gift Cards. Peacock or its suppliers may make partial shipments of any Gift Card order in its sole discretion. Peacock is under no obligation to provide notice of any expected delay for any shipment or delivery. Any estimates of shipping or delivery dates displayed or discussed online are preliminary, good faith estimates and will in no way be binding or create any representation or warranty by Peacock.

3.2. Risk of Loss. You assume any and all risk of loss upon delivery of any Gift Cards by Peacock or its supplier to the common carrier. Insurance will not be provided by Peacock or its supplier on any Gift Card while in transit. Neither Peacock nor its suppliers will assume liability in connection with the shipment, nor will the carrier be construed to be the agent or representative of Peacock or its suppliers. Hold your Gift Cards securely and write down your Gift Card number and PIN in a safe place. Gift Cards are not reloadable and cannot be replaced if lost, stolen or used without authorization.

4. No Refunds, Exchanges or Resale; Other Restrictions. Gift Cards are not debit or credit cards. Gift Cards have no cash value, there are no credits, refunds or exchanges, and they may not be redeemed for cash, either before or after redemption, unless otherwise required by applicable law. Gift Cards are void where prohibited. A Gift Card is valid only if obtained from Peacock or an authorized third- party distributor. A Gift Card is not valid and will not be honored, and Issuer will not be liable, if obtained from unauthorized sellers or resellers, including through Internet auction sites. Gift Card cannot be resold.

5. Disclaimer of Warranties and Release

5.1. Disclaimer of Warranties. ISSUER AND ITS PARENTS, AFFILIATES AND SUBSIDIARIES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS OR ANY WEBSITES OR APPLICATIONS, INCLUDING ANY EXPRESS OR IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.

5.2. Release. You hereby release Peacock, Issuer, and all of their parents, affiliates, and subsidiaries from and against from any and all claims, losses, or causes of action (including attorneys’ fees) in connection with your purchase, acceptance and use of the Gift Cards and any activities related to purchases made with the Gift Cards.

6. Dispute Resolution.

6.1. Applicable Law. These Gift Card Terms, and the relationship between you and Issuer, will be governed by the laws of the U.S. and the State of Kentucky without regard to its conflicts of law provisions.

6.2. Other Dispute Resolution Terms. Except with respect to applicable law, the terms of Section 8 of Peacock’s Terms of Service will apply to any disputes that may arise between you and Issuer with respect to Gift Cards.
